The processing of personal data related to the use of the services provided by Assiny is described in this Privacy Policy, which should be read in conjunction with Assiny's Terms and Conditions of Use and, when applicable, in conjunction with the Terms and Conditions of Use of the company with which you may interact due to the use of Assiny's services.

This Privacy Policy establishes the rules regarding (a) how and for what purposes your personal data may be treated by Assiny, (b) with whom this data may be shared, and (c) how Users can manage their personal data. This Policy applies to all content producers who register on the Assiny Platform, consumers of content made available on the Platform, partner institutions, and any other third parties who relate to Assiny, hereinafter referred to as “you”, “Data Subject”, “your”, or “yours”.

Aiming to facilitate the reading and understanding of this Policy, we offer a Glossary that lists the meaning of expressions starting with capital letters in this or other Assiny Policies. Additionally, it is important for you to understand the specific meaning of the following expressions used in the context of privacy protection.
Data Processing and Applicable Legislation: According to the General Data Protection Law (Law No. 13.709/2018 or “LGPD”), “Processing” means any operation carried out with Personal Data, such as collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation or control of information, modification, communication, transfer, dissemination, or extraction.
Applicable Data Protection Legislation means, especially, the LGPD and any other laws and regulations regarding privacy, secrecy, and protection of Personal Data that are applicable and, if applicable, all guidelines, standards, rules, ordinances, regulations, and codes of practice and conduct issued by the National Data Protection Authority (“ANPD”) or other relevant supervisory authority.
Personal Data: According to the Applicable Data Protection Legislation, “Personal Data” is any information related to an identified or identifiable natural person, directly or indirectly. Therefore, however generic this may seem, Personal Data is any information that identifies you directly or any information that leads to your identification. Payment Services: Assiny may allow its partners (such as financial institutions, payment institutions, card networks, and banking correspondents) to offer their services in an aggregated manner, such as, for example, making a card available to Users.
User Account Data means data relating to the User that is necessary for the provision of services offered by Assiny.
Creator Account Data means personal data that is processed by Assiny on behalf of the Content Creator, when personal data is transferred to the Creator and/or extracted, collected, and/or generated directly by the Creator.
PERSONAL DATA PROCESSED BY ASSINY
The personal data processed by Assiny may vary according to each personal data processing practice, as well as the type of user interaction with the Platform. This personal data may be collected directly from the user or collected automatically.
Below are listed the personal data collected by Assiny, presented in distinct categories and forms of collection to facilitate your understanding:
Personal Data collected directly from the User: Assiny may collect personal data directly from you when you, for example, create an account, initiate a purchase process directly, and/or interact with Assiny by any means, including through our chatbot.
“Offline” Interaction: Assiny may collect personal data when you interact with it by means other than accessing the Platform, such as, for example, your registration data when you participate in an event organized by a third party whose activity is contractually linked to Assiny.
Public Data: Assiny considers some personal data as public because it can be seen by anyone, inside and outside the Platform, including if that person does not have an account on the Platform. Information that can be viewed or accessed through third-party tools, such as search engines, APIs, and offline media, or through third-party applications, websites, and other services, is considered public data.
Personal data obtained from third parties: Assiny may have access to certain personal data through third parties, whether registration or banking information. This happens, for example, when, due to compliance with a legal or regulatory obligation, Assiny needs to consult databases maintained by third parties that enable credit restriction analysis, anti-fraud analysis, and other risk management analyses integrated into the Platform. Assiny also collects registration information through third parties when you link, connect, or log in to the Platform through a third-party service (e.g., Google or Microsoft).
Personal Data collected automatically when accessing the Platform: Personal data is collected automatically when you access the Platform, even if you do not have an account on the Platform. This information may include the examples below:
Payment transaction information: payment instrument used; date and time of the transaction; payment amount; expiration date of the payment instrument; billing postal code; IBAN information, address, and other details related to the payment transaction.
Access or usage information: pages and content you view; searches for ads; frequency of use of the Platform; browser information; connection data; purchase history and browsing history.
Log data and device information: details about how you accessed and used the Platform (including links accessed); IP address; dates and times of access; hardware and software information; device information; device event information; crash data; cookie data, pixel and similar technologies, and the pages you viewed or interacted with before and after accessing or using the Platform.
Participation in Creator Content: When you enroll in a course, Coaching service, or use or access other Creator content, we collect personal data related to your participation in the Creator Content, such as the courses you enrolled in, test results, your progress, and certifications.
Creator Payment Information: We use third-party payment gateways to process payments made through the Platform. For payments processed by Assiny Platform's native payment gateways, third parties provide information related to the payment status of your purchase, requiring you to link your payment account to the Platform to receive your payments. By linking your account, we will receive certain information related to your payments. Additionally, we will collect certain personal information for tax purposes, which may include your full name, address, and registration number. Our third-party payment gateways are independent and have their own privacy policies. For additional information on how your payment data is processed and stored by third parties, we recommend that you review the privacy policies of the payment gateways.
Participation in Creator Content: When you enroll in a course, use or access other Creator content, we collect personal data related to your participation in the Creator Content, such as the courses you enrolled in, test results, your progress, and certifications.
PURPOSES OF PERSONAL DATA PROCESSING
Assiny processes your Personal Data for the following purposes, by adopting an appropriate legal basis, in accordance with the Applicable Data Protection Legislation:
Develop the Platform:
Personalize the Platform according to the browsing experience;
Conduct analyses, research, and studies related to behavior, interest, and demographics;
Improve the Platform;
Archive purchase history;
Update registration;
Send messages, updates, and account notifications;
Perform User support activities;
Allow the User to publish their content;
Disseminate User content through the means available on the Platform.
Provide and optimize advertising and marketing activities:
Perform event registration;

Send educational materials or e-books;
Conduct media campaigns focused on advertising and promotions;

Participate in the arrangement with card networks/brands;
Accredit and issue payment instruments;

Maintain a safe environment:
Perform authentication with the Platform;
Verify the authenticity of the data and documents provided, including through processing and cross-checking;
Send announcements;
Perform analysis activities for fraud prevention, security incidents, and abuses on the Platform;
Registration verification;
Content verification.
Purposes of Visitor Personal Data Processing: We may collect personal data from Platform visitors for the following purposes:
Media campaigns focused on advertising and promotions;
Send communications, such as email marketing, remarketing, and other advertising campaigns on media channels;
Analyze your browsing behavior on the Platform;
Perform event registration;

LEGAL BASES FOR PROCESSING
The Processing of Personal Data carried out by Assiny is always based on a legal basis provided for in the Applicable Legislation. The legal bases used by Assiny may vary depending on the processing context, and include the following:
Consent: When the User manifestly accepts the Processing of Personal Data, such as, for example, when agreeing to receive advertising communications or surveys. This consent can be revoked at any time by the user.
Compliance with legal or regulatory obligation: When Assiny is obliged to carry out the Processing of Personal Data due to a legal or regulatory determination, such as, for example, when Assiny stores access logs for compliance with anti-money laundering legislation.
Performance of Contract or procedures related to the Contract: When the Processing of Personal Data is necessary for the execution of a contract signed between Assiny and the User, or when necessary for preliminary procedures to the contract, such as, for example, when we need to process your payment data when you make a purchase on the Platform.
Regular exercise of rights in judicial, administrative, or arbitral proceedings: When there is a need for Personal Data Processing due to a lawsuit, administrative, or arbitral procedure.
Legitimate interest: When Assiny decides to proceed with the Processing of Personal Data after a careful analysis involving the evaluation of the purpose and necessity of the processing to the User and the User's expectation regarding the processing of Personal Data. This legal basis is used when, for example, Assiny sends a newsletter related to the User's interests, considering their interaction with the Platform, to assist in supporting and promoting Assiny's activities. In this case, Assiny always provides the user with the option to cancel the receipt of these communications.
PERSONAL DATA RETENTION PERIOD
We will store your Personal Data only for the period necessary to fulfill the processing purposes for which the Personal Data was collected, as described in this Policy. We may, in addition, keep your Data for an additional period to fulfill our legal or regulatory obligations, for the regular exercise of our rights in judicial, administrative, or arbitral proceedings, or to meet any of your needs, such as, for example, if you make a request to us. If there is no longer any applicable legal basis for the processing of your Data, they will be removed from our systems and records or will be anonymized, which means that the information will no longer be able to identify you or make you identifiable.
The Personal Data collected by Assiny will be processed by the company until at least one of the hypotheses below is reached:
Achievement of the processing purpose.
The personal data is no longer necessary or pertinent to achieving the specific intended purpose.
Termination of the Contract with the User, for whatever reason.
Exercise of the right of revocation of consent by the User, in cases where the processing of personal data was carried out based on this legal basis.
Any penalty applied by the body responsible for overseeing, implementing, and monitoring compliance with the applicable legislation, or by other competent bodies.
In certain situations, Assiny may residually retain personal data even after the hypotheses for termination of personal data processing, due to compliance with a legal or regulatory obligation, or in circumstances where there is a legitimate purpose for Assiny to maintain the personal data. In these cases, personal data will be stored in a secure location with restricted access and for the time necessary to comply with the legal or regulatory obligation, or until the end of Assiny's legitimate purpose.
The retention periods for personal data differ and depend on the type of information and the objectives for which we use the information.
SHARING OF PERSONAL DATA
In some situations, for the purposes described above, Assiny may share some of your Personal Data with other companies, including marketing platforms (Google Ads, Facebook/Meta Ads) and third parties hired by Assiny. These third parties will be classified as Data Processors. We will only share with third parties the Personal Data strictly necessary for the provision of Assiny's services, to comply with legal and/or regulatory obligations, or to comply with any of the purposes provided for in this Policy.
Assiny, as responsible for the Processing of Personal Data, in compliance with the LGPD, will contractually require that third parties who have access to your Personal Data act securely and adopt all technical security measures to guarantee compliance with the Applicable Data Protection Legislation and, additionally, this Policy.
Among Companies in its Economic Group: Assiny may also share your Personal Data with individuals or legal entities that are, in any way, involved in corporate operations to which Assiny is a party, such as acquisitions, incorporations, mergers, among others. The sharing of personal data may occur between parent companies, subsidiaries, affiliates, or companies under common control of Assiny, or any companies of the Economic Group, to enable the services of the group companies, generate administrative efficiencies, and facilitate the use of different services by the same user.
Service Providers: Your Personal Data may be shared with third parties involved in financial advisory, accounting, legal activities, non-profit activities, and potential investors, as well as third parties involved in providing data backup, cloud computing service providers, or to conduct analytical studies.
Finally, Assiny may have a duty to disclose your Personal Data to authorities or other applicable entities to: (i) comply with our legal or regulatory obligations; (ii) investigate possible rights violations; (iii) guarantee your security and the security of third parties, for example, being necessary to share your data with police authorities; (iv) detect or prevent fraud and technical difficulties; (v) exercise our rights or allow our customers, visitors, employees, partners, or other service providers to exercise their rights; (vi) investigate, prevent, or take measures related to illegal or suspicious activities, or to cooperate with public bodies; and (vii) comply with legal obligations or any other determination before Government and Judiciary bodies.
We will maintain this sharing only to the extent necessary to comply with these obligations. We emphasize that, in any case, the sharing of your Personal Data will take place through the adoption of appropriate technical and organizational measures, aiming at the confidentiality and integrity of the information (anonymization and encryption).
International Transfer of Personal Data: Occasionally, Assiny may transfer your Personal Data outside of Brazil. In these cases, we only transfer your Personal Data outside of Brazil securely and in accordance with the Applicable Data Protection Legislation. As a rule, the transfer will be made to countries or international organizations that provide a degree of Personal Data protection adequate to that provided for in the Applicable Data Protection Legislation. Since some countries may not have adequate legislation regulating the processing and international transfer of Personal Data, we adopt measures to ensure that third parties comply with the commitments established in this Policy. These measures may include the analysis of the privacy and security standards of third parties and/or the signing of appropriate contracts, with specific clauses on the processing of Personal Data.
Payment Services: Personal Data is also shared with third parties when the User, in some way, makes use of Payment Services. Personal data, including card numbers, will be shared with the credit card network/brand and the partner payment institution. This sharing has the sole purpose of processing the payment, and Personal Data is not stored by Assiny, being only shared with the partner for the purpose specified above.
Sharing of Information between Users: When you participate in Creator Content, Assiny may share certain information with the Creator to allow the Creator to provide services to you. This information includes: (a) account information, such as your name and email address; (b) payment information, such as the amount paid, your address, and other billing information, but never your full credit card number; (c) your IP address; (d) information about your participation in the Creator Content, including your enrollments, progress, test results, and certificates; (e) any message you have exchanged with the Creator through the Platform. When you use Assiny services to publish Creator Content, information contained in your Creator Content will be visible to Users who have access to the Creator Content. For example, when you publish your bio on a sales page, personal data in your bio will be visible to people visiting the sales page.
Integrated Services: When the User decides to integrate third-party services, their personal data will be shared with these third parties. We recommend that you read the terms of use and privacy policies of these third parties to understand how they collect, use, and share your personal data. Third-party services are operated, controlled, and maintained by third parties, without any relationship with us.
Business Partners: Assiny partners with third parties to offer events, promotions, contests, and other programs. To participate in these offers, you may be asked to provide your email address and other personal data.
Advertisers and Analytics Providers: We may share your Personal Data with advertisers, ad networks, and analytics providers through cookies or other technologies.
Governmental, Police, or Judicial Authorities: Assiny may be required to share your personal data with governmental, police, or Judicial authorities whenever necessary to comply with a court order or request from the respective authority.
RIGHTS OF THE PERSONAL DATA SUBJECT
Depending on the laws applicable to the Processing of your Personal Data, you may have certain specific rights regarding your personal information. Listed below are the applicable rights:
Confirmation of the existence of processing: You have the right to ask us if we process your personal data, confirming the existence or not of such processing.
Access to data: You have the right to request a copy of your personal data that is processed by us, by electronic, secure, and suitable means or in printed form, according to your preference.

Information about the possibility of denying consent: You have the right to receive information about the possibility of not providing your consent, when consent is the applicable legal basis for the processing of personal data, with an indication of the consequences of this refusal.
Revocation of consent: At any time, you have the right to revoke the consent you have previously granted, easily and free of charge. It is important that you know that the revocation of consent does not invalidate or make illegitimate the personal data processing activities that were carried out before the date of revocation.
Opposition to processing: In cases where consent is not the legal basis applicable to the processing of your personal data, and when there is any non-compliance with the data protection law, you have the right to oppose the processing, indicating your reasons for doing so. Assiny will evaluate whether your opposition is justified or not, adopting the necessary measures to suspend the processing or inform the grounds on which it understands that the processing is lawful and permitted.
Complaint: You have the right to contact and/or petition the ANPD to file a complaint against Assiny's data protection and privacy practices. However, we ask that you do not hesitate to contact us, through the contacts of our Data Protection Officer (DPO), indicated above, before filing any complaint with the competent data protection authority, so that we can try to resolve your question or complaint immediately.
Deletion of data processed with consent: In cases where your consent is the legal basis for a certain processing activity, you have the right to request the deletion of such data, except for the possibilities of our continuing to store the data when necessary for compliance with a legal or regulatory obligation, or for the defense of our interests in judicial, administrative, or arbitral proceedings.
